As members are aware NSW Trustee & Guardian announced its Phase 2 Overview on 9 December 2016, which is a further change to the planned implementation of the new structure.

There has been no consultation with the É«ÀÇÉçÇøabout this departure to the Phased Implementation Plan and the É«ÀÇÉçÇøhas now applied for the dispute to be relisted in the Industrial Relations Commission. The matter is now listed in the Industrial Relations Commission (IRC) for 16 December 2016.

NSW Trustee & Guardian is now arranging to meet with the É«ÀÇÉçÇøabout the Phase 2 Overview and the É«ÀÇÉçÇøwill advise the outcome of this meeting.

There have been regular appearances in the IRC with the matter listed on 19 September 2016 and
8 November 2016.

During both appearances, the É«ÀÇÉçÇøraised numerous concerns about the NSWTG Phased Implementation Plan, including the following:

  • ongoing workload crisis & other WHS issues
  • staff morale
  • extended technology delays
    lack of training & support for staff
  • lack of clarity about processes
  • concerns about change management and appropriate implementation
  • concerns about the Service Delivery Model
  • concerns about the impact of the changes upon our members.

The É«ÀÇÉçÇørepeated its concerns to the IRC that NSW Trustee & Guardian would not be ready to implement the new structure by February 2017. The É«ÀÇÉçÇøalso noted that Trustee & Guardian had not undertaken the preparation recommended by Price Waterhouse Coopers in its report on the Pilot.

The IRC recommended the parties embrace the Price Waterhouse Coopers report and that there be continued consultation with the É«ÀÇÉçÇøabout the Phased Implementation Plan.

The IRC also recommended that a further report be obtained by Price Waterhouse Coopers before proceeding to implementation in February 2017.

It is worth noting that the Phase 2 Overview announcement was made without a further report being done by Price Waterhouse Coopers.

The É«ÀÇÉçÇøseeks feedback from members about the impact of these changes and will continue to protect members’ interests at this difficult time.
