Crown Solicitor’s Office – dispute update

At the end of last year, the É«ÀÇÉçÇøfiled a dispute in the NSW Industrial Relations Commission (IRC) over the Crown Solicitor’s Office’s (SCO’s) proposed Change Management Plan for the areas of Finance & Support Services, and Enterprise Systems Organisational Structures.

The matter was before Commissioner Webster in December 2020. As a result of the É«ÀÇÉçÇøsubmissions to the Commissioner regarding the CSO’s failure to properly consult regarding the restructure, the period of consultation was extended until 29 January 2021.

A report back to Commissioner Webster occurred on Friday, 5 February 2021. The É«ÀÇÉçÇøreported that further consultation had occurred between the parties, however, there were substantive issues regarding workload which the parties did not agree upon. Particularly, as the É«ÀÇÉçÇøhas repeatedly stressed to the CSO, the É«ÀÇÉçÇøis concerned about the workload implications of the restructure on the Elite team as well as on the legal teams due to the significant shortcomings of Elite. As a result, at the IRC, the CSO committed to consultation with the É«ÀÇÉçÇøregarding the implementation of the new structure and Elite upgrades.

Concurrently, the É«ÀÇÉçÇøis also perusing these workload issues through SafeWork. A service request with SafeWork was filed last week based on the above issues. The É«ÀÇÉçÇøremains ready to file a further dispute at the IRC under the IRC’s Work, Health and Safety jurisdiction should the matter not be resolved.

Members will be kept up to date regarding the restructure. The É«ÀÇÉçÇøwill commit to fortnightly meetings for members on the issue. Notice will be issued shortly regarding these meetings.
