Members, following the horrific assaults that occurred at Frank Baxter and Cobham and of course the incident at Frank Baxter on Sunday afternoon where detainees took control of the centre by trashing a unit and then climbing onto the roof where they remained for some 24 hours plus, how does your Executive Director, Ms Hawyes thank you? By deducting your salaries.

On Sunday, 9 June 2019 members across the state ceased unsafe work under Section 84 of the WHS Act 2011 that allows a worker to cease unsafe work. Unsafe work is defined as work that is a “serious risk to the worker’s health or safety, emanating from an immediate or imminent exposure to a hazard”.

As you are aware, following the ceasing of unsafe work under Section 84 of the WHS Act, Juvenile Justice took the ɫto the NSW Industrial Relations Commission. The matter was heard before Commissioner Sloan.

What disgusts the ɫis that those who have been physically injured, those of you who witnessed these assaults and those that aided negotiation of removing the detainees from the roof at Frank Baxter, your actions in ceasing unsafe work of Sunday, 9 June, your Executive deducts your pay.

The action taken on Sunday is not a breach of the Award nor is it a breach of the Industrial Relations Act.

The ɫfollowing this attack on you has taken immediate steps by lodging a dispute with the IRC.

Frank Baxter motions

The matters as raised at Frank Baxter on Tuesday, 11 June included:

  • Variation to the detainee routines, the DRMPs, the liaison with the Police and the Enhanced Support Unit along with the other matters as presented to A/g General Secretary, Mr Troy Wright.

We are able to advise that these matters remain in ongoing negotiation with the ɫmeeting today with the Secretary, Mr Coutts-Trotter and Ms Hawyes.

A further update will be provided following this meeting.
