The É«ÀÇÉçÇøis pleased to announce you should commence receiving your uniform allowance from June 2023. In addition, you will receive back pay for the time the allowance was not paid in the past.

In February 2023, the É«ÀÇÉçÇøwrote to the Department of Education (DoE) about its failure pay General Assistants their entitled Laundry Allowance. Your union also informed the Department that members are entitled to back pay.

The Laundry Allowance is a condition under the Crown Employees (Public Service Conditions of Employment Reviewed Award 2009) for employees whose duties require specialised or protective clothing.

The Award directs staff who receive a uniform or PPE as part of their role shall be paid the allowance for laundry expenses.

The oversight was first raised with the Department in the PSA/DoE Joint Consultative Committee on 17 October 2022.

The DoE will make retrospective payment to the beginning of the 2017 school year. This meets the six-year limitations period for taking action to recover arrears of income.

Lastly, the É«ÀÇÉçÇøadvises members to seek professional advice on financial and taxation matters from accredited financial advisors. The É«ÀÇÉçÇøis unable to provide members with independent financial advice, nor should we seek confidential private information concerning your individual taxation and financial matters.

Your union has been involved in a protracted dispute with the Department in relation to travelling compensation and meal expenses.

With the help of the Industrial Relations Commission (IRC), an agreement was struck to resolve the É«ÀÇÉçÇøDispute with the Department of Customer Service (DCS) in relation to the interpretation and application of clauses 26 and 29 of the Crown Employees (Public Service Conditions of Employment) Reviewed Award 2009.

As per requirement of the agreement to resolve the dispute, the Department agreed it would instigate a review into claims lodged by employees under Clauses 26 and 29 between 12 December 2017 and 25 May 2022 and would rectify any payment that may not have been made properly.

É«ÀÇÉçÇøis pleased to advise members that the Department identified over 900 past and present employees who have been underpaid to the tune of $130,000.

Payments will be making their way to you in the coming days.

É«ÀÇÉçÇøis still negotiating with DCS in relation to a small number of individual members with outstanding claims in this regard but other than that, we consider the matter of unpaid lodged claims now closed.

We are however still in dispute around the definition of a field worker and what that means in relation to entitlement to a meal allowance.  We are back in the IRC next week and will provide a further update to members in due course.

We would like to thank you, our members, for your patience during the time it has taken to get this significant win for you.

On Thursday 12 January 2023, CSNSW and the É«ÀÇÉçÇøappeared in the Industrial Relations Commission as part of the consent application to rescind the Crown Employee (Correctional Officers, Department of Communities and Justice) Award for Kempsey, Dillwynia, Wellington and John Morony (KDWJ Award), and transition affected staff to the following Awards relevant to their classification:

  • Crown Employees (Correctional Officers, Department of Communities and Justice – Corrective Services NSW) Award
  • Crown Employees (Senior Assistant Superintendents and Assistant Superintendents, Department of Communities and Justice – Corrective Services NSW) Award
  • Crown Employees (Custodial Executive Ranked Officers, Department of Communities and Justice – Corrective Services NSW) Award

Orders made

The Chief Commissioner made the orders to affect the above change, and as a result the KDWJ Award has been officially rescinded!

What does this mean?

Essentially this means that if you were covered by the KDWJ Award, as of Monday 16 January 2023 you transitioned to one of the above Awards (dependent on your classification) and will receive the entitlements contained within this Award.

A win for members

The rescission of the KDWJ Award has been consistently raised by delegates and members as an issue that needed to be addressed.  Thanks to the dedication of your É«ÀÇÉçÇødelegates, as well as the cooperative and consultative approach taken by CSNSW on the issue of Award consolidation, this outcome has now been achieved.

On Friday 13 September the PSA’s legal team attended The NSW Industrial Relations Commission (IRC) to report the outcome of the vote and finalise the new Award. 98.75 per cent of É«ÀÇÉçÇøSAS Staff members voted to ACCEPT the pay equity package in a historic win for pay equity in NSW.

Unusually, the Full Bench of the NSW IRC made the Award on the day of hearing. The Award will be uploaded to the É«ÀÇÉçÇøwebsite next week for members to access we will advise when it is available.

Congratulations to all members for your contribution to your union. It is only because of you that we were able to run this case.
