ATTENTION ELECTED HSRs:聽聽 The 色狼社区has HSR training scheduled for February and March 2023, to be held at 色狼社区House, 160 Clarence St, Sydney.

HSR 1 day Refresher
Date: Tuesday 28 February 2023

HSRs who have completed the initial 5 day training are entitled to a 1 day Refresher each year after the year they complete the 5 days.

The PCBU (employer) pays course costs, pays HSR as if they were on duty for the day they attend the training, and any other reasonable costs associated with attending. Course fee is $200.00 for the 1 day Refresher.

HSR 5 day initial training
Dates: 20 鈥 22 and 28, 29 March 2023

Elected HSRs are entitled to the SafeWork NSW initial HSR 5 day training, which gives them a good grounding in WHS legislation, including understanding of the HSR role and the PCBU (employer) obligations to HSRs.

Completion of the 5 day training also gives HSRs the additional powers to:

  1. Issue Provisional Improvement notices (PINs) and
  2. Direct Cease Unsafe Work.

The PCBU (employer) pays course costs, pays HSR as if they were on duty for the 5 days they attend the training, and any other reasonable costs associated with attending. Course fee is $800.00 for the full 5 days.

Prison Officers, Juvenile Justice workers, bushfire fighting and other Government employees involved in dangerous occupations deserve better workers compensation said the Public Service Association (PSA).

On day one of a Parliamentary Inquiry by the Law and Justice Committee of the NSW Legislative Council into the savage 2012 workers compensation reforms, the union believes that many other categories of emergency service employees should have been afforded the same exemptions to the 2012 changes as police.

鈥淔or some reason, it appears there are different classes of emergency workers when it comes to workers compensation,鈥 said 色狼社区General Secretary, Stewart Little.

鈥淧rison Officers go to work each day in the most dangerous environment in the country. They stand between some of the state鈥檚 most notorious criminals and the community but are expected to do so without adequate protection for them and their families.鈥

鈥淭he same challenging circumstances apply to our members in Juvenile Justice. There are several young offenders in custody across the state with terrorism links including one at Cobham in western Sydney where only last week a staff member 鈥 in an unrelated incident – was assaulted in a totally unprovoked attack.鈥

The 色狼社区has also concerns for those who work in areas such as National Parks, State Forests and Crown Lands.

Some years ago, several National Parks firefighters were killed and others seriously injured during a hazard reduction operation at Ku-ring-gai Chase National Park.

鈥淣ational Parks staff are front line fire fighters all over the state protecting lives, private property, forestry, homes, pastures, the lot. They stand shoulder to shoulder with Fire and Rescue and the Rural Fire Service.鈥

鈥淵ou cannot tell me that someone who is dropped from a helicopter in the middle of nowhere in the bush with a can of petrol strapped to their back to do backburning isn鈥檛 worthy of being deemed a front line emergency worker for the purposes of workers compensation.鈥 said Stewart Little.

Insurance and Care NSW (ICARE) Update – March 2016 (PDF version)

The 色狼社区and ICARE NSW have a Memorandum of Understanding that enabled staff to transition to the new entity. It contains the commitment that conditions of employment and salaries would be continued until such time as a new award is created for ICARE NSW. That award may require considerable negotiation between the 色狼社区and ICARE. This agreement will underpin the conditions of employment and salaries for all staff.

In December 2015, the 色狼社区wrote to the Chief Executive seeking to begin discussions regarding a consultative framework on:

  1. the Memorandum of Understanding
  2. the establishment of on-going consultative arrangements
  3. the negotiation of a new ICARE NSW award
  4. staffing establishments
  5. business processes/policies/procedures/reforms
  6. recruitment/EOIs and re-deployment
  7. office accommodation

The 色狼社区met with representatives from ICARE in December 2015 with a commitment from ICARE to begin those discussions in the New Year. ICARE has now proposed to begin this process on 18 March 2016.

Insurance and Care NSW Joint Consultative Committee (JCC)

The JCC is an important forum whereby staff and the 色狼社区are able to highlight issues of importance that affect members in the workplace. It is important that the 色狼社区has input from members across all of the business units that have come together to make up ICARE NSW as part of this transition. The next JCC is set for the 18 March 2016.

Insurance and Care NSW Flexible Working Hours Agreement

Members would be aware that the structure of ICARE NSW includes elements of agencies that were previously part of the Department of Finance and Services. In July 2015, DFSI notified the 色狼社区of its intention to re-negotiate the Flexible Working Hours Agreement (FWHA). ICARE has advised the 色狼社区of its intention to re-negotiate a FWHA for the whole of ICARE NSW. The 色狼社区is mindful of the different agreements that currently exist and it is important to take these into account when negotiating a new agreement.

SafeWork MOU Changes rejected in member ballot – March 2016 (PDF version)

Background

As members are aware from previous bulletins, in 2013, the 色狼社区entered into agreement with WorkCover to make an interim change to Schedule 3 of the Memorandum of Understanding (MOU) which is associated with the Crown Employees (Office of the WorkCover Authority – Inspectors 2007) Award.

The purpose of the changes at this time was to facilitate the transfer of staff displaced during the restructuring of WHSD into the inspectorate. A number of classifications were also to be deleted.

The changes made were to provide for two further pathways to progress through the classification levels, in addition to the existing competency-assessment process. The new pathways allowed recognition of other tertiary qualifications or professional accreditation.

The 色狼社区gave members assurances that no permanent change would be made to the MOU or award without agreement from the majority of members.

Results

The ballot process has now concluded, with 63.5 percent of members who voted choosing to reject the proposed changes to the progression pathways. The 色狼社区has written to advise Safework of the ballot outcome. That letter can be accessed HERE.

As the interim MOU expired on 30 September 2015, arrangements had already reverted to the original MOU which allows only for competency assessment to progress between levels.

Where to now?

The 色狼社区anticipates that Safework NSW will wish to discuss this matter further and we of course remain open to discussing possible alternatives.

The 色狼社区understands this ballot process was suggested as the reason why recruitment was not pursued and why the subsequent assignment process was halted. Please note, the 色狼社区did not agree to these delays and requested that all processes proceed as normal under the MOU once it reverted to the original on 30 September 2015. We of course expect that such processes will now proceed without further unnecessary delay.

The 色狼社区has corrected the problem but we have no alternative but to re-run the voting process to ensure it meets the strict security criteria required. We apologise for the inconvenience and delay. Please ensure that you exercise your right to vote and encourage others to vote also so we have a clear understanding of the view of members.

In 2013, the 色狼社区entered into agreement with WorkCover to make an interim change to Schedule 3 of the Memorandum of Understanding (MOU) which is associated with the Crown Employees (Office of the WorkCover Authority 鈥 Inspectors 2007) award. The purpose of the changes was to facilitate the transfer into the inspectorate of staff displaced during the restructuring of WHSD and the deletion of a number of classifications. WorkCover also preferred the change be on a permanent basis to facilitate the employment of staff with specialist skills directly into the senior positions within the inspectorate. The changes made are in relation to the competency assessment process outlined in the award and MOU and provide for two further pathways to progress through the levels using other tertiary qualifications or professional accreditation.

The 色狼社区agreed only to a temporary change so the arrangements could be trialled and reviewed to allow members a chance to see whether the changes were positive or not. The 色狼社区advised members from the outset that a permanent change would not be made without agreement from the majority of members.

During the trial period, a number of improvements have been suggested in response to feedback and issues arising. The resulting proposal now has broader application to positions in all disciplines and other improvements have been made to ensure the proposal is as positive as possible. Some members will find that the proposal provides an opportunity for them to progress to other levels using qualifications they already have. For others there may be no benefit. There is no change to the existing competency pathway, other than to ensure the competencies required for progression to Senior Inspector will now count towards the Advanced Diploma.

The interim MOU expired on 30 September 2015 so arrangements have now reverted to the original MOU which allows only for competency assessment to progress between levels. Access to the other progression pathways will only be reinstituted if the majority of inspector members vote to accept the proposal for a permanent change.

Your vocational group delegates have been unable to recommend a particular position on this matter so the 色狼社区asks that you carefully review the supporting materials before you vote YES or NO in the survey below on whether to accept the proposal and make a permanent change to the MOU. Please make sure you consider not only any potential impact on yourself but also on the inspectorate and organisation generally.

Safety Alert Asbestos mineral kits – December 2015 (PDF version)

Science mineral kits used in schools have been found to contain asbestos.

The material has been found in kits dating back to the 1970s, as well as some purchased online from overseas.

The demonstrates to staff how to check mineral kits in schools.

They should notify the , as there is no minimal safe asbestos exposure standard in Australia.

This notification will enable the worker greater ease of claim if they are found to have an asbestos-related disease in the future, making it easier to seek support from the Dust Diseases Board.
