Application to the Industrial Court of New South Wales to Compensate Solicitors for Unpaid Work (Forfeited Flex & Unpaid Overtime)

The É«ÀÇÉçÇøis preparing an unfair contract application to the Industrial Court of New South Wales on behalf of ODPP solicitors who have forfeited flex or worked unpaid overtime between 1 January 2018 through to the present day.

A claim to compensate ODPP solicitors for their unpaid work

The work of ODPP solicitors is essential to the proper functioning of the justice system in NSW, and that work should be fairly compensated.

As the recent IRC , for many years now the ODPP has benefited from solicitors having high workloads, resulting in tens of thousands of flex hours being forfeited, as well as solicitors working unpaid overtime outside of bandwidth hours and on weekends.

The PSA’s goal is to compensate ODPP solicitors for their unpaid work, which we know for many members had a significant impact on mental and physical health and wellbeing.

Join the claim – your urgent action is needed

Is this you?:-

  1. Are you a current ODPP solicitor or did you resign within the last year?
  2. Are you a current É«ÀÇÉçÇømember (including those who have recently joined)?
  3. Have you:
    1. Forfeited flex hours, and/or
    2. Worked unpaid overtime (outside of bandwidth on weekdays, or anytime on weekends) doing work that was required because of your workload, and not been paid for it?
  4. Would you like the É«ÀÇÉçÇøto seek compensation on your behalf for the unpaid work you have done that has benefitted the ODPP?

If you answered yes to all of the above, please fill in this by no later than 5pm on Thursday 11 July.

For many years, the É«ÀÇÉçÇøhas fought for members to have safe workplaces, manageable workloads and genuine access to their Award entitlements such as flex time and flexible work.

The work you do is so important to the community but the other side of child protection is the impact it can have on the workers.

The Safe Staff Safe Kids Campaign calls on the NSW Government and the Department of Communities and Justice to implement all the recommendations from PSA’s best practice model for mental health and wellbeing:

  1. Cultural and organisational change
  2. Peer Support Program
  3. Mental health and wellbeing are key strategic priorities
  4. Appointment of Chief Psychologist and a team of psychologists
  5. Clinical/professional supervision
  6. Dedicated time away from frontline child protection work
  7. Complete overhaul/reform of recover at work program
  8. Hotline for caseworkers
  9. Panel of secular and non-secular chaplains
  10. Child protection workforce strategy
  11. Annual well-being checks for all caseworkers, MCSs and MCWs
  12. Partnerships with mental health NGOs – Beyond Blue and Black Dog Institute

The research underpinning Safe Staff Safe KidsÌý

The É«ÀÇÉçÇølaunched this important campaign during Mental Health Month in 2020 because the biggest workplace issue facing child protection workers right now is mental health and wellbeing.

We know this because the É«ÀÇÉçÇøcommissioned a research project to identify the parts of child protection work that most impact members and us this information develop a best practice model for mental health and wellbeing specific to the context of child protection.Ìý The project looked at the impacts of workplace violence such as threats and assaults, vicarious trauma and extreme workloads, which can lead to psychological injuries affecting all workers in child protection.

The outcomes of this project showed that psychological injury in Community Services was higher than that in Ambulance and Police.

The results of the project underpin the Safe Staff Safe Kids Campaign.

SAS Staff are Worth 100%

The É«ÀÇÉçÇøknows SAS Staff are worth their weight in gold. That is why our ongoing campaign for SAS Staff is “Worth 100% – Paid. Protected. Permanent. “

Ìý100% PAID

After many years of building our case and collecting and lodging evidence, we have finally concluded our pay equity case for SAS Staff resulting in the already reported 19% pay rises over 3 years.ÌýÌý We will now continue work on the other two elements of our campaign – protected and permanent.

100% PROTECTED

Over the last few years there has been an alarming increase in incidents of workplace violence, workload and work intensification in schools. Incidents are events that create danger or risk that could significantly affect the health, safety and wellbeing of individuals including physical, near misses and psychological risk.

The É«ÀÇÉçÇøwill fight for members to be 100 per cent protected no matter where you work in the school.

Incidents may include, but not be limited to; spitting, hitting and kicking when working with students as well as the significant psychological pressure placed on administrative staff due to workloads. Both physical and psychological incidents can have a detrimental impact on your wellbeing.

100% PERMANENT

In 2020 the É«ÀÇÉçÇøsupported numerous members to be made permanent during our term 4 permanency drive. This was a huge success with many School Learning Support Officer and School Admin Officer members being provided permanent work on a full or part time basis.

However, as a result of Local Schools Local Decisions job security continues to be undermined with many School Administrative and Support Staff (SASS) remaining in insecure work for years.

Over 60% of SASS in some classifications are temporary employees.Ìý This has impacted their ability to apply for home loans or have security around their income so they can plan for the future.

The É«ÀÇÉçÇøbelieves that long term temporary SAS Staff should be converted to be permanent so that they have a secure job for the future and is continuing to fight for a genuine pathway to permanency for all SAS Staff as well as other improvements to your conditions.

The public sector has suffered under eight years of Coalition Government and its agenda to reduce the services we provide to the NSW community. This cannot continue.

The attack on public servants continues:

  • Efficiency dividend – how can departments save 12% over four years without cutting staff?
  • $60 billion worth of assets sold off to the private sector. The gifting of ageing and disability has left our most vulnerable without a safety net.
  • Casualisation – more staff in the public service are on temporary contracts and working as casuals; with fewer people working for the community of NSW.
  • Wages cap – NSW is Australia’s most expensive state to live in, and the cost of living is going up; yet the Government’s wages cap holds our pay rises back.
  • Workplace Flexibility – we were promised flexible workplaces; but someone seems to have forgotten to tell our bosses.
