A report by lobby group GetUp has exposed the loopholes used by corporate tax dodgers.

Closing the Caribbean Connection found:

  • Australia lost $5.37 billion to corporate tax dodging from just 76 foreign multinationals in 2013 and 2014
  • these billionaire corporations pay a lower effective tax rate than your average nurse
  • big pharmaceutical corporations paid the lowest effective tax rate at just 5.7 percent, compared to 7.5 percent for high-tech corporations and 20 percent for energy corporations
  • there are two major loopholes that are being exploited by multinational corporations: Debt Loading and Profit Alienation, and effective policy solutions to both of these loopholes have recently been implemented in Hong Kong and Britain.

ECEC Advisory Group

The 色狼社区Early Childhood Education and Care Advisory Group is a group of elected 色狼社区members who regularly meet throughout the year with ECEC management to raise and address issues.

ECEC Advisory Group Meeting

The last ECEC AG meeting with management was on 18 June 2014.

The following matters were raised:

  • Re-engagement of temporary employees with regard to the Government Sector Employment Act (GSE) with reference to employment beyond 鈥4 years鈥 was discussed.
  • It was confirmed that confirmation letters for temporary employees until 23.2.15 had been sent.
  • ECEC was allocated $306 million in the budget for grants primarily for funding of Children鈥檚 Services.
  • 色狼社区raised concerns that positions are still not being filled or backfilled and budget has not been properly allocated.
  • There is still no update or any details to release as to when the proposed staff-realignment will occur.
  • Some discussions have taken place as to a possible reconfiguration of the regions but the overall budget needs to be constructed first by the Director of Partnerships and Programs.
  • Concerns from staff involved in the EOI for 1st tier reviews and resulting workloads.

Management report back notes

  • An overall improvement of processes.
  • 24,000 supervisor applications processed.
  • Elements in assessment and rating being streamlined. Not being enacted on in NSW as still waiting on the outcomes and training must be implemented.
  • Not going to meet A+R targets set down. (Commonwealth has been informed)
  • Leading the work nationally to reform the A+R around systemising visits etc.
  • There has been a break through on templates and details streamlining review of templates.
  • This should help defend against being accused of just having 鈥榦wn opinion鈥.
  • Streamlining makes it more challenging to provide evidence not implemented.
  • New tool will be rolled out.
  • Comes into effect formally from 1 June 2014

The separation of DEC and TAFE has led the 色狼社区to seek clarification from the Department regarding what transitional arrangements are being made and the impact this could have on staff seeking redeployment and joint consultative committees.

People and Services Directorate Restructure

This restructure has moved to the final step of the placement process. As this restructure is taking in the former HR Directorate which was meant to introduce SAP HR Shared Services in 2010 as part of the LMBR reforms, there is an unusually high number of temporary employees (approximately 100) where the usual number to be considered is normally less than 10.

The Department鈥檚 position for consideration of long-term temporaries (previously section 31 appointments under the PSEMA) was that it would lead to a significant disadvantage to the majority of temporary employees. The Department decided not to implement step 5 of the placement process and went straight to external advertising after consideration of excess employees.

The 色狼社区met with a number of members who are impacted by this stage of the restructure, particularly in the 鈥楥asual Direct鈥 area at the Blacktown State Office and is following up on a number of issues, particularly the eligibility for a severance payment for a number of long-term temporary employees who were casual conversions.

Additionally, the 色狼社区has also become aware that the Department is trying to get a variation to the bandwidth of hours currently worked by staff in Casual Direct to start from 6.00 am to avoid current penalty rates paid to staff.

Asset Management Directorate 鈥 Phase II Restructure
The 色狼社区was advised that the restructure has been finalised and 11 staff received advice on 18 June 2014 declaring them excess.

Finance Shared Services Restructure

It was anticipated that in early June proposed organisational charts and draft role descriptions would become available for the beginning of the consultation process after the feedback from the initial functional chart.

The Department has now advised that it will not be in a position to release draft organisational charts until听听 July /August. The timeframe put forward would see the new structure in place in early 2015.

Office of Education Review (incorporating State Training Services) Restructure

Again, this has been a long anticipated restructure. The Department has yet to begin consultation with the PSA. We have been advised that the State Training Services part of the review which was aborted last year is likely to be brought forward.

Technology Support Officers 鈥 End of DER Program

With the announcement that the NSW Department of Education will not continue the funding for the Commonwealth DER program many TSO鈥檚 finished their employment on 27 June 2014.

On Friday 6 June 2014 the Department released an advice to Principals on how to retain a TSO role in their school.

If you are being retained by your school it should be as a TSO 鈥 Clerk Grade General Scale and the duties should be in line with your previous position description under the DER program.

The 色狼社区is also concerned that schools should not expect or ask for any of the TSO鈥檚 work to be done by SASS or any other staff in schools.

Finally, the 色狼社区is providing advice to those TSO鈥檚 not continuing their employment who may be eligible for a severance payment.

Early Childhood Education and Care Directorate 鈥 Advisory Group Management Meeting 18 June

The 色狼社区ECEC advisory group meets regularly with management to raise members鈥 issues and review how the directorate is operating.

Unfortunately, at this time we still have no clear indication as to when the proposed restructure for the ECEC Directorate will be ready for discussion. This does impact temporary employees as it is difficult to provide any certainty until we know what the proposed structure is.

ECEC Visits and AG Elections

Organisers will shortly be arranging to visit metro ECEC offices to meet with members. We will also be calling for nominations from 色狼社区members to be on the advisory group. TAFE/DEC Joint Consultative Committee Update

A report was provided to brief the JCC in May on the progress of SAP Finance and HR.

TAFE/DEC SAP Finance upgrade

TAFE + DEC Corporate replacing current SAP Finance system on 1 July 2014 which will allow for proper accounting at a business unit level, such as:

鈥 Balance sheet reporting
鈥 Profit + Loss Management

Along with the functionality upgrades for most users it will be a like for like swap. The current status for the project is 鈥榓mber鈥 and there are only a relatively small number of issues still to be resolved but none of these are expected to push out the expected delivery date of 1 July 2014.

The old system will be closed for transactions, but will still be available as a 鈥楤rown system鈥 and all new financial year accounting will be in the new system.

Pilot training for the new SAP finance system such as 鈥楾rain the Trainer鈥 鈥 through May, end user training in June in line with its introduction has been developed and tested.

SALM -TAFE

This has a current target date for delivery on 7 October 2014. Its current status is 鈥楻ed鈥 and there are certain critical periods if the target delivery date cannot be met (such as November 鈥 March) in which it cannot be implemented due to the operational requirements in TAFE.

LMBR will be reviewing over the next 6 weeks as to the status re: target date of 7 October. LMBR will be conducting a review over the next 6 weeks in re the status of the target date of 7 October.

SALM training will be similar to the schools which will be a blended approach of face to face and a combination of computer/ application based module training, with each individual TAFE implementing training around its needs.

There has been 1 pilot run for SALM but there will be two main waves:

– Early training
– Delta training

FACS Bulletin: Code of Conduct February 2014 (PDF Version)

The Department of Family and Community Services is asking staff to sign up to a new Code of Ethical Conduct (CoEC) without properly explaining it to staff or consulting with the PSA.

Members have contacted the 色狼社区to express their concern and we鈥檝e notified the Department of a dispute.

Members are particularly concerned about the section in the new CoEC dealing with social media and e-learning.

The 色狼社区has reviewed the CoEC and we鈥檙e worried it may infringe on our members right to participate in union campaigns (as per cl.64 of the Crown Employees Conditions of Employment Award 2009) or exercise their freedom of political expression in their private life.

We鈥檙e also concerned about the Department directing staff to undertake on-line training and sign a document that they may not fully understand. We think the Department should make face to face training available 鈥 through Learning and Development Units 鈥 at the nomination of the staff member.

We鈥檝e notified the Department of a dispute and we鈥檙e advising members not to complete the e-learning module or sign up to the CoEC until proper consultation has occurred, and our concerns are addressed.

WORRYING TREND AWAY FROM TRANSPARENCY AND CONSULTATION

The Code of Ethical Conduct represents only one of a number of recent examples of apparent failures to consult over employment policies that have a direct impact on the way our members do their jobs.

These include:

  • Code of Ethical Conduct
  • Social Media
  • Information Security
  • Delegations Training

The Award requires the Department to consult on 鈥渕atters of mutual interest and concern鈥 including proposed changes to employment practices and policy.

We have raised this issue with the Department and have requested an urgent meeting. Pending this, we鈥檙e advising members not to undertake the e-learning modules attached to these policies. We鈥檙e encouraging members to contact us if they would like to discuss this advice further 鈥 9220 0900.

NRW Poster 2013听is celebrated across Australia each year between 27 May and 3 June. The dates commemorate two significant milestones in the reconciliation journey鈥攖he anniversaries of the successful 1967 referendum and the High Court Mabo decision.

The week is a time for all Australians to learn about our shared histories, cultures and achievements and to explore how each of us can join the national reconciliation effort.

May 27 marks the anniversary of Australia鈥檚 most successful referendum听and a defining event in our nation鈥檚 history. The 1967 referendum saw over 90 per cent of Australians vote to give the Commonwealth the power to make laws for Aboriginal and Torres Strait Islander peoples and recognise them in the national census.

On 3 June, 1992, the High Court of Australia delivered its landmark Mabo decision听which legally recognised that Aboriginal and Torres Strait Islander peoples have a special relationship to the land鈥攖hat existed prior to colonalisation and still exists today. This recognition paved the way for land rights called Native Title. 2012 marked the 20th anniversary of the Mabo decision.

What is the theme for 2013?

The theme for this year is听Let鈥檚 Talk Recognition鈥攚ith a focus on how Australians can better recognise each other, and recognise the contributions, cultures and histories of Aboriginal and Torres Strait Islander peoples. But how you interpret the theme is entirely up to you. It could be as simple as:

  • Playing Aboriginal or Torres Strait Islander听听in your workplace or classroom
  • Starting a听听飞补濒濒
  • Purchasing an artwork for your office, school or university
  • Displaying the听
  • Learning more about听.

We all know the importance of recognition and how good it makes us feel. National Reconciliation Week is the perfect opportunity to recognise all Australians, and the unique place of Aboriginal and Torres Strait Islander peoples within this country.

A NSW Government bill seeks to remove legislative protections for the merit selection process in the public service creating a greater risk of nepotism and political appointments, the Public Service Association said today.

The Government Sector Employment Bill introduced last week by the O鈥橣arrell Government eliminates a number of important checks and balances. These are in place to protect transparency, accountability and professional advice untainted by political pressure, said 色狼社区General Secretary Anne Gardiner.

The Bill weakens the merit selection process. This process ensures appointments are based on open competition and transparent selection criteria.

鈥淭his bill is an attack on the independence and the quality of the NSW public service,鈥 said Ms Gardiner.

鈥淭he Bill undermines the integrity of the public service by making it easier to employ casual and temporary staff. It also retains measures that mean senior public servants can be terminated without reason. Together these changes will threaten the ability of public sector workers to provide frank and fearless advice.

鈥淚t鈥檚 important that public servants are able to do their jobs in a professional manner and give advice to the government without fearing they鈥檒l be put out of a job.

鈥淎 casualised public service, without transparency or job security, cannot deliver the public services or policy and administrative support NSW needs.

鈥淭he Government has introduced a bill that lacks important checks and balances. Critical details that should be included in legislation are being left to be worked out without appropriate public scrutiny,鈥 said Ms Gardiner.

鈥淭he Public Service Association calls on the government to consult widely before proceeding further with this bill. This is a major change to the structure of the public service that shouldn’t be rushed. Good government depends on getting this right.鈥

The National Disability Insurance Scheme (NDIS) will commence its trial period in the Hunter from July this year. The government has just released the rules around eligibility for inclusion in this trial and the others taking place around the country.

听The following is an Australian Government summary:

The Australian Government has released rules that will guide how the National Disability Insurance Scheme (NDIS) works for people with disability, their families, carers and service providers.

The rules support the National Disability Insurance Scheme Bill 2012, which is currently before the Australian Parliament. The Bill establishes the NDIS, including eligibility criteria and what constitutes reasonable and necessary support. It also establishes the NDIS Agency to deliver the Scheme.

The rules provide a further level of detail on how the NDIS will work, including how people with disability will be able to access the scheme, and how the Agency will determine what supports are reasonable to meet a person鈥檚 needs.

The rules now released cover these aspects of the scheme:

  • NDIS Rules for becoming a participant
  • NDIS Rules for the protection and disclosure of information
  • NDIS Rules 鈥 Support for participants
  • NDIS Rules 鈥 Children
  • NDIS Rules 鈥 Nominees
  • NDIS Rules 鈥 Rules for registered providers
  • NDIS Rules 鈥 Plan Management
